Terms of Service

This amendment is supplemental only. It applies solely to the extent that its subject matter is not already addressed in the policy above, and it does not replace, supersede, limit, or narrow any provision of that policy. Where the policy above addresses the same subject matter, the policy above controls.

The Tools

In this amendment, the "Tools" means the software applications made available under the eBiz123s brand — including SplitWin (splitwin.ai) and other current or future applications such as CampaignIQ and Castplane — whether accessed through an eBiz123s membership, purchased individually, or used on a free tier.

License

To the extent not addressed above: your purchase or membership grants a limited, non-exclusive, non-transferable right to use the Tools for your own business while your subscription or membership remains active. You may not resell, sublicense, copy, or reverse-engineer the Tools, except that a White Label license expressly permits rebranding and resale in accordance with the license materials delivered with that purchase.

Accounts & access

Tool accounts are provisioned automatically after purchase or membership activation, via an access link sent to your email address. You are responsible for maintaining the security of your account credentials. Access to a Tool included with a membership tier remains available while that membership is active; if the membership lapses or is cancelled, the Tool account reverts to its free tier and your data within the Tool is retained and remains exportable.

Acceptable use

To the extent not addressed above: you may only deploy measurement or testing features of the Tools (such as the SplitWin snippet) on websites you own or are authorized to operate, and you are responsible for compliance with laws applicable to your own visitors, including obtaining any required consents.

Tool-specific terms

Individual Tools may publish supplemental terms or agreements on their own domains (for example, the SplitWin Data Processing Agreement at splitwin.ai/dpa.php). Those documents apply to the relevant Tool in addition to — not instead of — the policy above and this amendment.

Third-party video content (Videoplane)

Videoplane displays overlays on top of video content that you supply by URL; it does not copy, host, or modify the underlying video file. You are solely responsible for having the necessary rights and permissions to present, frame, and overlay any video you add — including videos hosted on third-party platforms, whose own terms of service may restrict embedding or framing. We may disable a video or an account in response to a rights-holder complaint.

Honest-marketing features

Some Videoplane features (countdowns, scarcity counters, unlock mechanics) present urgency or exclusivity to your viewers. You are responsible for using them truthfully and in compliance with consumer-protection law applicable to your audience. Default configurations are designed to be honest (timers that do not reset, labels on estimated figures); overriding them is at your own risk.

Early access (Buildplane)

Buildplane Lifetime purchases made before it goes live are early access: the product is under active development and features may change before it goes live. The purchase grants lifetime access to Buildplane once it goes live, at no further charge, together with any early-access benefits described at the point of sale.
